NEW RULES ON ORGAN TRAFFICKING

DEAR PUA MEMBERS,

Today, we met with the Department of Social Work Secretary, Dr. Esperanza Cabral, and the Department of Justice Undersecretary Ricardo Blancaflor who is also concurrently the Chair of the Inter-Agency Council Against Trafficking (IACAT).

Subject of the meeting was the new IRR or Implementing Rules and Regulations on the Trafficking of Organs which took effect last  June 21, 2009.

The IRR is several pages long and is available to you upon request from the PUA secretariat. But for the sake of brevity, let me just highlight for you the most important points in the IRR that will affect you if you are engaged in kidney transplantation (as a donor surgeon).

1. The IRR defines  "trafficking of persons"  as "recruitment, transportation, transfer or harboring, or receipt of persons by means of threat, use of force or other forms of coercion, abduction, fraud..... taking  advantage of the vulnerability of persons.... for the  purpose of slavery.... or  removal or sale of organs.

2. IT may occur WITH OR WITHOUT THE VICTIM'S (or donor's) CONSENT.

3. IT prohibits the giving of "VALUABLE CONSIDERATION" (money or anything of value ) to the donor in exchange for his donation (other than reasonable payments like hospitalization expenses, costs of medical work-up, costs of medicines and follow-up, incidental to the operation).

4. As medical practitioners, we are required to report any circumstance in which we suspect that a person was trafficked for the removal or sale of organs. Failure to do so shall be a ground for an administrative proceeding or criminal liability.

5. No foreigner can receive an organ from a Filipino non-related donor (including spouses)

6. Violation of the IRR can mean a fine of not less than 1 million pesos but not more that 2 million pesos and imprisonment of between 15-20 years.

In essence, it affects the way we practice LIVING NON RELATED KIDNEY TRANSPLANTATION. Please confer with your transplant team and transplant surgeon and hospital ethics committee on measures which you may have to take in order to ensure that you do not unwittingly commit a violation of the IRR.

My suggestions are as follows:

1. Confine your operations to living related or cadaveric transplantation.
2. If you will do a living non related transplantation, it would be better if it was the recipient who brought the donor to you and ensure that there will be no exchange of payment or "valuable consideration" for the donation. If you cannot ensure this, you can have the donor and recipient pair get approval from first , your hospital ethics committee and then, for the next 2 months, the CHair of the IACAT who is USec. Blancaflor at the Department of Justice. Hopefully after two months, they would have another mechanism in place to approve or deny such donations.
3. "Ignorance" of the fact that payment took place does not excuse you from liability. In fact, everyone in the team, including the ethics committee members are liable.
4. The IACAT has given out a prescribed "donor consent form" which you should use, which should be notarized. Each of the transplant centers who attended the meeting got a copy. I can provide you one if you need it.
5. DO NOT ENGAGE DONORS WHO ARE "WALK-IN" OR THE NON-DIRECTED, NON-RELATED DONORS. THEY ARE CLASSIFIED AS OUTRIGHT "SELLERS". ALSO, DONORS FROM FOUNDATIONS WHO HAVE BEEN PROCESSED UNDER THESE CIRCUMSTANCES ARE GOING TO BE SUSPECT AS ORGAN SELLERS.

Please be very careful with the above IRR. The IACAT, DSWD, NBI and PNP are serious with the implementation. If you have any questions, you can call me up anytime.

The Asia Oceania (research organization on) Genital Infections and Neoplasia - Philippines (AOGIN-RP) will be holding its first Annual Convention on February 21, 2009 at the Garden Ballroom, EDSA Shangri-La.

A series of interesting and relevant scientific lectures by prominent local speakers as well as practical modules for adult vaccination and single visit approach for cervical cancer prevention have been lined up for the whole day. In this regard, we would like to be a good opportunity for all of us to have an update on scientific advances in genital infections and neoplasias int he Philippines.
